federally registered motor carrier (USDOT 2117041) operating

freight transportation, dispatch, and related logistics services.

We respect your privacy and are committed to protecting the

personal information of our job candidates, drivers, employees,

brokers, shippers, website visitors, and any other individuals

who interact with us.

This Privacy Policy explains how EMR Express Inc. collects,

uses, discloses, retains, and protects personal information

when you:

- Apply for employment or inquire about driver positions

- Work for us as a driver, employee, or contractor

- Engage with us as a broker, shipper, vendor, or business

By using our website, applying for employment, accepting

employment, engaging in business with us, or opting in to SMS

communications with us, you agree to the terms of this Privacy

This Privacy Policy applies to EMR Express Inc. and any

subsidiaries, affiliates, or divisions operating under its

DOT authority.

1. INFORMATION WE COLLECT

We collect personal information directly from you, from third

parties you authorize, and automatically through your use of

our website and services. The categories of personal information

we collect include:

a) Contact Information

Full legal name, mailing address, email address, mobile and

landline phone numbers, emergency contact information, and

preferred contact methods.

b) Identity and Eligibility Information

Date of birth, Social Security number, government-issued

identification numbers, work authorization status, and

citizenship or residency information required for employment

eligibility verification.

c) Employment and Driver Qualification Information

Driver's license number, CDL class and endorsements, state

of issuance, employment history, driving record (MVR), DOT

medical certification, drug and alcohol testing records,

background check results, previous employer verifications,

fingerprints where required, driver qualification file

contents, and other information required for federal motor

carrier compliance under 49 CFR Parts 382, 383, and 391.

d) Financial and Compensation Information

Bank account information for direct deposit, tax

identification numbers (W-4, W-9, 1099), pay and settlement

records, benefits elections, retirement account information,

garnishments, and expense reimbursement records.

e) Operational and Performance Information

Vehicle assignments, load assignments, hours-of-service logs,

electronic logging device (ELD) data, telematics and GPS

location data during working hours, fuel card transaction

records, toll transponder records, safety event records, and

driver performance evaluations.

f) Communications and Consent Records

Records of phone calls, emails, SMS text messages, and

in-person conversations with EMR Express Inc. personnel,

including consent records, message content, timestamps, and

attestation logs for verbal consent capture.

g) Commercial Counterparty Information

For brokers, shippers, factoring companies, and other

business counterparties: business name, MC number, contact

person information, payment terms, credit history, and

transactional records.

h) Website Usage and Device Information

IP address, browser type and version, operating system,

pages visited, referring website, session duration,

clickstream data, and timestamps, collected through standard

web analytics tools, server logs, and cookies.

2. HOW WE USE YOUR INFORMATION

We use personal information for the following business

purposes:

a) Employment Administration

Processing job applications, conducting recruiter screening,

verifying employment eligibility, performing background

checks and drug and alcohol testing as required by federal

regulation, administering onboarding, maintaining driver

qualification files, managing compensation and benefits, and

handling separation and post-employment records.

b) Operational Execution

Dispatching loads, tracking shipments, communicating with

drivers during transport, invoicing shippers and brokers,

paying drivers and vendors, managing vehicles and equipment,

fuel and toll administration, and coordinating with insurance

carriers.

c) Safety and Regulatory Compliance

Complying with federal and state regulations applicable to

motor carriers, including FMCSA, DOT, FMCSR, EPA, IRS, state

workforce agencies, and state departments of transportation.

Reporting accidents, safety events, hours-of-service

compliance, drug and alcohol testing results, and regulated

driver records.

d) Communications

Responding to inquiries, providing customer and driver

support, sending operational notifications, recruiting

communications, retention communications, and exit

communications as described in Section 3.

e) Legal and Business Protection

Protecting our legal rights, preventing fraud, investigating

suspected unauthorized activity, enforcing contracts, and

responding to legal requests.

f) Analytics and Improvement

Analyzing website and service usage, improving our platform

and services, and developing new features for our drivers,

dispatchers, and business counterparties.

3. SMS TEXT MESSAGING PROGRAMS

EMR Express Inc. (USDOT 2117041) operates SMS text messaging

programs registered with The Campaign Registry (TCR) for the

following distinct purposes:

a) Recruiting Communications Application-link outreach sent to job candidates following verbal consent provided during the recruiter phone screening call.

b) Driver Retention Communications Onboarding check-ins, satisfaction surveys, and operational support inquiries sent to active drivers who have provided written consent as part of signed employment documentation.

c) Driver Operational Fallback Communications SMS messages sent to active drivers as a fallback communication channel when primary dispatch communication methods (driver application, voice call, email, or in-cab device) are unavailable or unsuccessful. These messages may include load assignments, pickup and delivery directions, appointment updates, and urgent operational coordination. Fallback SMS is used sparingly and only when primary channels cannot deliver time-sensitive information. Use is authorized through the signed employment documentation of active drivers.

d) Exit Communications Feedback solicitation and offboarding information sent to departing drivers until explicit revocation.

Additional SMS programs may be added in the future for

operational communications with brokers, shippers, and other

business counterparties. Any such programs will be registered

with The Campaign Registry and will require their own

express opt-in consent from recipients.

CONSENT REQUIREMENTS

All SMS recipients must provide express opt-in consent via our

web opt-in form located at:

The form requires:

- The recipient's full legal name

- The mobile phone number that will receive SMS

- An unchecked-by-default consent checkbox explicitly

authorizing SMS for the stated purposes

- Typed signature attestation confirming ownership of the phone

number provided

Candidates additionally provide verbal consent during a

recruiter phone screening call, which is captured and attested

in EMR Express Inc.'s internal consent log with recruiter name,

candidate name, phone number, date, time, and purpose of

consent. The web form serves as the secondary written

confirmation of this verbal consent.

Active drivers additionally provide written SMS consent as part

of signed employment documentation, which explicitly authorizes

retention and feedback communications during active employment.

Departing drivers retain consent until explicit revocation via

STOP reply or written request.

CONSENT IS NOT A CONDITION OF EMPLOYMENT. Candidates and drivers

may decline SMS consent without any effect on employment

opportunities or ongoing employment status.

MESSAGE FREQUENCY

Message frequency varies based on recruiting pipeline stage,

driver tenure, and operational needs:

- Candidates typically receive 1 to 3 messages per week during

active recruiting

- Active drivers typically receive 1 to 2 messages per month

- Departing drivers typically receive 1 message during

offboarding

MESSAGE AND DATA RATES

Standard carrier rates apply to all SMS messages sent and

received. Message and data rates may apply. EMR Express Inc.

does not charge any additional fee for SMS messages beyond

your carrier's standard rates.

OPT-OUT AND HELP

You may opt out of SMS at any time by replying STOP to any

message you receive from EMR Express Inc. Upon STOP, you will

receive a one-time confirmation message and no further SMS

messages will be sent. To re-subscribe after opting out, reply

START to the unsubscribe confirmation message.

Reply HELP to any SMS message to receive support contact

information.

You may also opt out or request help by contacting us directly

at privacy@emrexpressinc.com or at the phone number in

Section 9.

SUPPORTED CARRIERS

Our SMS programs work with all major U.S. mobile carriers,

including AT&T, Verizon, T-Mobile, and their MVNOs. Carriers

are not liable for delayed or undelivered messages.

SMS RECORD RETENTION

SMS consent records are retained for the duration of the

consenting relationship plus four years thereafter, in

compliance with FCC and TCPA requirements. You may request a

copy of your consent record by contacting us using the

information in Section 9.

NO SHARING FOR MARKETING

EMR Express Inc. does not share, sell, or rent SMS opt-in data,

phone numbers, or consent records with any third party for

marketing purposes under any circumstance.

providers (Telnyx), payroll processors, background check

services, drug and alcohol testing facilities, insurance

carriers, benefits administrators, banking and payment

processors, fuel and toll card providers, telematics and

ELD vendors, IT service providers, and professional

advisors. These providers are contractually obligated to

protect your information and use it only for the purpose

of providing services to EMR Express Inc.

b) Business Counterparties

In the ordinary course of freight operations, we share

limited driver and shipment information with brokers,

shippers, consignees, and factoring companies as necessary

to execute transportation services and process payments.

Shared information is limited to what is necessary for

operational purposes.

c) Legal and Regulatory Compliance

We disclose information when required by law, regulation,

court order, subpoena, or government request, including

reporting to the FMCSA, DOT, IRS, state tax and workforce

agencies, and law enforcement.

d) Safety and Investigation

We may share information as necessary to investigate

suspected fraud, safety incidents, accidents, cargo claims,

or violations of our policies.

e) Business Transfers

If EMR Express Inc. is involved in a merger, acquisition,

reorganization, or sale of assets, personal information may

be transferred as part of that transaction, subject to

continued protection under a privacy policy at least as

protective as this one.

f) With Your Consent

We may share information for other purposes with your

explicit consent.

We do not share SMS opt-in data or phone numbers with any

third party for marketing purposes.

6. DATA RETENTION

- SMS consent records: retained for the duration of the

consenting relationship plus four years thereafter

- Business counterparty records: retained for the duration of

the business relationship plus seven years

- Website analytics data: retained up to 26 months in

aggregated form

legal retention obligations, by contacting us using the

information in Section 9.

electronic storage is completely secure, and we cannot guarantee
